OBJECT OF THE CONTRACT

The present General Terms are about the sale of services of access, through Web streaming, to video lessons and/or full courses available in the catalogue of International Telematic University UNINETTUNO and accessible from the Store of the website of International Telematic University UNINETTUNO and from UNINETTUNO APPs.

The user purchases on International Telematic University UNINETTUNO Store or through UNINETTUNO APPs for iOS or Android the right to access a video lesson and/or a course, he purchases the right to access them through a PC or mobile equipment for period of time of 12 months.

These General Terms regulate distance purchase (in accordance with the Legislative Decree N. 206/2005 – Code of Consumption and with the Legislative Decree N. 70/2003 – Electronic Commerce Law) for the purchase of the services of International Telematic University UNINETTUNO Store, based in Rome (00186) Corso Vittorio Emanuele II, n. 39 - VAT N.  13937651001

It will be possible to amend this contract upon prior notice to the user or notification on the website.
The contract between International Telematic University UNINETTUNO and the User will be concluded upon receipt by International Telematic University UNINETTUNO of the payments of the amounts due for the services offered.

The User has to carefully read the various items of the General Terms.

REGISTRATION ON THE WEBSITE

In order to purchase services of access to the video lessons and/or courses on the Store of International Telematic University UNINETTUNO website it is required to register to the website.
The User is deemed as the only person responsible for the account and as such he engages in promptly communicating to International Telematic University UNINETTUNO any non-authorized use of his own account or password as well as any breach of the security rules he gets to know. International Telematic University UNINETTUNO shall, by no means, be considered responsible for any damages deriving from the non compliance to the above-mentioned provisions.

The User is aware of the fact that, in order to regulate the access to the selected video lessons and/or courses, his accreditation is subject only to the check of the account and password he utilizes. As a consequence, the User is responsible for the maintenance and fair use of his account and password as well as for any harmful effect against International Telematic University UNINETTUNO or against third parties resulting from the non fair use, loss and confidentiality of the restricted account and password.

PURCHASE METHODS

In order to purchase the video lessons and/or courses illustrate in UNINETTUNO catalogue, the User shall access to the page of the Store of International Telematic University UNINETTUNO and once he has selected the video lessons and/or courses he wishes to access to, he will have to follow a short procedure during which he will have to enter his personal data and pay according to the methods available.

The user, once he accepts the purchase of the selected video lessons and/or courses through the Store of International Telematic University UNINETTUNO, authorizes International Telematic University UNINETTUNO to use its payment methods to charge each purchased products and each additional amount (taxes and fees for delayed payment, if applicable) that may result from or related to his account. The user is responsible for the prompt payment of all due amounts and accepts to offer International Telematic University UNINETTUNO a payment mode that is valid for the relative payments.

The total cost includes the price of the product and, in addition, any VAT applicable (in force on the day of the transaction).

After checking if the purchase is correct (video lessons, courses, payment modes etc.) the user shall state that he has carefully read and accepts the General Terms and then confirm the purchase.

The confirmation of the purchase entails a complete awareness of the General Terms and their integral acceptance.
Once he completes the purchase, the User engages in printing and keeping a record of these General Terms.

PAYMENT METHODS

The payment methods accepted by UNINETTUNO are as follows:

1) Credit card: in case of purchase of goods by credit card payment, the charge to the credit card takes place upon completion of the purchase procedure.

2) Bank transfer

DELIVERY OF THE VIDEO LESSONS AND/OR COURSES

Once the payment is made International Telematic University UNINETTUNO will deliver the service according to the following modes:

1) In case of payment by credit card the user will automatically receive a confirmation and authorization e-mail message enabling the user to view the video lessons and/or courses.

2) In case of payment by bank transfer, the user will be enabled to view the selected video lessons and/or courses as soon as he will have submitted to International Telematic University UNINETTUNO an original copy of the receipt.

The purchase of the video lessons and/or courses will give right to the possibility of accessing the selected video lessons and/or courses for a 12-month period starting from the actual authorization submitted to International Telematic University UNINETTUNO by the User.

The User acknowledges that International Telematic University UNINETTUNO is not responsible for any temporary connection problems due to the computer equipment used by the User or dependent on the server of the website.

The access to the video lessons and/or courses does not entail the support or presence of a tutor.

RIGHT OF WITHDRAWAL

The User, as physical person, is acknowledged the right to refuse the purchases made, with no penalty and with no obligation, to give a justification within 10 working days from the initial date of implementation of the service by notification made in writing and sent by fax or e-mail.

Upon withdrawal on the user’s part, made in accordance with the above-mentioned provisions and no later than 30 days starting from the withdrawal date International Telematic University UNINETTUNO will credit the paid amounts to the user without applying any fees due for the payment.

The user acknowledges that the right of withdrawal, as per Legislative Decree 206/2005, can be exercised only if he is a consumer, that is a physical person who purchases services for purposes non referable to his own professional, i.e. he does not purchases them supplying his VAT number as reference.

The right of withdrawal is excluded in all cases in which the service implementation has already started; the services promoted by International Telematic University UNINETTUNO start when the user displays, for the first time, the video lesson and/or course, excepting unsuccessful transaction. If this happens, the user shall notify International Telematic University UNINETTUNO as soon as possible writing to:webmaster@uninettunouniversity.net.

AMENDMENTS

International Telematic University UNINETTUNO reserves the right to amend this contract at any time with the purpose of enhancing its service; the amendments shall be notified to the User by e-mail or by notices posted on the website.

If the User refuses to accept these amendments, UNINETTUNO shall have the right to withdraw from the contract.

CARACTERISTICS AND USE OF THE CONTENTS OF THE SERVICES

The system requirements needed to use the selected video lessons and/or courses are available on the website, at the “Technical Information” page. International Telematic University UNINETTUNO reserves the right to modify the contents’ options (including suitability for specific characteristics) without prior notification.

The user agrees that International Telematic University UNINETTUNO products are supplied only under license. The user is authorized to use International Telematic University UNINETTUNO products only on personal basis, not for commercial purposes. Once the transaction related to a course or a lesson is completed, the user has a 12-month period to use them freely, with no limitations as it regards the number of times he uses them.

The user acknowledges that the website of International Telematic University UNINETTUNO, as well as the contents and services available on the website are protected by the laws regulating intellectual and/or industrial property.
Consequently, the reproduction of the video lessons and/or courses and their use for purposes different from those established by this contract are forbidden.

INFORMATION ON THE PROTECTION OF PERSONAL DATA

The information, as any other data directly and indirectly referable, to a specific user, are collected and used in compliance with the Legislative Decree 196/2003 (Code regulating the protection of personal data) and with the regulations on privacy.

DISPUTES AND COMPTENT COURT

These General Terms and the relations between International Telematic University UNINETTUNO and the user are regulated by the laws in force in the Italian Republic. Any dispute arising or referring to these General Terms will be of exclusive competence of the Court of Rome.
